You should understand that by ordering any of our Products you
agree to be bound by these conditions.

Our Products
Our products consist of wines and champagnes and associated
products (such as la barbe's voucher, hampers, event tickets
etc) as well as luxury foods (the "Products").
Service availability
Our carriers deliver Products ordered from this site within
the United Kingdom.
Your status
By placing an order through our web site you warrant that:
you are legally capable of entering into binding contracts;
and you are at least 18 years old.
How the contract is formed
All orders are subject to acceptance by us and we will confirm
such acceptance to you by on-line electronic means (the "Confirmation").
We expressly reserve the right to refuse any order made by
a customer with whom we have an ongoing dispute, or from anyone
we suspect of making purchases on our site by fraudulent means.
Prices and Payment
The prices for any Products ordered will be as quoted on our
web site from time to time, except in the case of obvious
errors. All prices are exclusive of VAT and the cost of standard
delivery (see "Delivery"). Please note that when
paying by credit card your total will be debited in £ Pound
Sterling.
You may pay for an order by credit card or by cheque (made
payable to la barbe). Credit card payment can be made either
on-line (via our SSL secure payment system), or by fax (01737
226387) or phone using one of the following debit/credit cards:
SWITCH, VISA or MasterCard. We will debit your debit/credit
card before we acknowledge your order. However, delivery of
any Products ordered from our web site is subject to authorisation
of your credit card payment by the bank payment centres, or
clearance of your cheque.
Where the order concerns wines, part payment for the wine,
which includes excise duty but excludes VAT and delivery charges,
is due on the date the order is acknowledged. The final payment
(including VAT, transport and excise duty) is due when you
receive our final invoice when the Products become available
for delivery.
Delivery
Once your order is received we will contact you within five working days from the date of payment to arrange delivery
Every Product offered on our web site is generally available
either at the producers or at our warehouse. We try to establish
availability of the Products ordered by you before acknowledging
your order. Where this is not possible for any reason and
where the Product turns out to be temporarily unavailable,
we may offer a replacement Product of equal or increased value
to you. You have the right to accept or refuse this replacement
Product. If you choose to refuse it you will be able, at your
option, to either order another Product from our web site
or claim a refund of monies if already paid.
Ownership
We retain ownership of any Products ordered until we have
received full payment for such Products. However, risk in
the Products will pass to you upon delivery.
Our Refund Policy
You may cancel your order at any time and for any reason within
14 days of delivery of the Products ordered. In this case
you must notify us of your wish to cancel in writing and you
must return the Product(s) to us at your expense in their
original wrapping, intact and accompanied by all accessories
and documentation which were part of the delivery. We will
refund any monies paid to us in respect of a cancelled order
within 30 days of receiving your notice of cancellation.
Warranty
We warrant that any Product purchased through our web site
is of satisfactory quality. If you have any reservations or
comments about the appearance of or quality of our Products,
you should state these on our carrier's delivery statement.
Alternatively, you must notify us of any complaints you may
have within 1 month. Unless we receive such a complaint from
you within the period stated, you will be deemed to have accepted
delivery of the Products in accordance with your order.
If you notice an obvious defect within 1 month from the date
of delivery of the Products, we will replace the defective
Product at our cost with a Product of similar or better value.
Our Liability and Disclaimer
Our liability in connection with any Products purchased through
our web site is strictly limited to the purchase price of
such Products. This does not exclude or limit in any way our
liability for fraud, or for death or personal injury caused
by our negligence, or any other liability to the extent that
it may not be excluded or limited as a matter of law. As a
rule, we cannot accept any liability for changes to or defects
in the Products that are due to the Products' manufacturers.
We further accept no liability for any indirect or consequential
loss or damage, or for any loss of data, profit, revenue or
business, however caused, even if foreseeable. We accept no
liability for any minor errors or omissions that can remain
despite the precautions taken by us in the presentation of
the Products.

Notice will be deemed received 24 hours after the Web Request
or e-mail is sent or three days after the date of posting.
Your Personal Data
While you are browsing our web site and during the order process
we may collect information and personal data from you, which
we will use in accordance with our Privacy Policy.
Governing Law and Jurisdiction
English Law will govern contracts for the purchase of Products
through our web site. Any dispute arising from or related
to such contracts shall be subject to the non-exclusive jurisdiction
of the English Courts.
Security
In order to prevent any risk of misappropriation of your
credit card details, labarbe.co.uk employs a secure system
of payment, using tried and tested encryption protocols that
conform to SSL standards.
Your credit card details are directly encoded to our Internet
Billing Services provider's site, not ours.
Payment authorisation is administered directly by the bank.
Labarbe.co.uk receives notification of payment from the bank,
without receiving any of your credit card or bank details
when you pay online.

your credit card number over the Internet, there are other
